The adjusted official fees for patent procedures will be effective on January 1, 2010! |

Further to our most recent Newsletter issued last week, the TIPO announced on December 8, 2009 that the adjusted official fees for patent procedures in Taiwan will be effective on January 1, 2010.
We herewith list the adjustments of the official fees for patent procedures for your reference:

The request of the substantive examination
|
(1) Basic fee for the first fifty(50) pages of the specification and drawings: NT$8000
* Regardless of the number of the claims.

(1) Basic fee for the first fifty(50) pages of the specification and drawings within ten (10) claims : NT$7000
Fee for each additional claim in excess of the basic ten(10) claims: NT$800.

When there are amendments on the claims after the request of substantive examination, some official fees for the request of the substantive examination may be refunded to the applicant or may need to be paid to the TIPO under the following conditions:

The amendments are made voluntarily by the applicants before receiving the 1st official actions: |

Deletion of claims: The paid official fees for the deleted claims for the substantive examination will be refunded to the applicant except for the basic official fee for the substantive examination.

(2) |
Addition of claims: The additional official fee NT$800 for each additional claim should be paid if the total number of claims is in excess of basic 10 claims after the amendments.

The amendments are made after receiving the 1st official actions: |

(1) |
Deletion of claims: Because the claims have gone through the substantive examination, the refund of official fees for deleted claims is not available.
|

(2) |
Addition of claims: If the newly added claims plus the original claims are in excess of the basic 10 claims after the amendments, the additional official fee NT$800 for each additional claim beyond the said basis should be paid.
|

|
For those patent applications which are filed before January 1, 2010 but the requests of the substantive examination are made after the said date, the old official fees for the substantive examination shall remain applicable.
|

|
In addition, the applicants are allowed to withdraw their patent applications. If the applicants withdraw their patent applications before the examiners issue the 1st official notices, the applicants may apply for refund of the official fees of substantive examination. Furthermore, if the applicants withdraw their patent applications before the examiners issue the 1st official notices for the re-examination, the applicants may apply for refund of the official fees for the re-examination.
