During the examination of a pending patent application or after the patent is granted, it may be necessary to change the relevant information of the applicant or inventor. In such cases, the applicant should record the change(s) with the Taiwan Intellectual Property Office (TIPO) by submitting an application sheet and the required documents, along with any applicable official fees.
In addition to the application sheet, the following are the relevant supporting documents and fees required for each type of change:
- Change of the applicant’s address – No supporting document is required.
- Change of the attorney – A Power of Attorney (PoA) with an official fee of NT$300.
- Change of the company’s legal representative – No supporting document is required.
- Change of the applicant’s name – A supporting document that reflects the name change, along with an official fee of NT$300.
- Change of the applicant’s name (foreign legal person) – A supporting document issued by the foreign government or an affidavit signed by the applicant, along with an official fee of NT$300.
*The affidavit should include the name change, the reason for not being able to provide a supporting document, and a statement that the applicant is willing to bear all legal responsibilities.
- Change of the applicant’s signature/seal – An application sheet that includes the original and new forms of signature/seal, along with an official fee of NT$300.
*If the original seal has been lost or the application sheet is filed only with the new signature/seal, the applicant should submit an affidavit as a supporting document. If the applicant is a natural person, an identity document should also be filed.
- Change of the patentee's signature/seal – An application sheet that includes the original and new forms of signature/seal, along with an official fee of NT$300.
*If the original seal has been lost or the application sheet is filed only with the new signature/seal, the registrant should submit an affidavit as a supporting document. If the registrant is a natural person, an identity document should also be filed.
- Change of the applicant’s/inventor’s nationality (natural person) – No supporting document is required.
- Change of the inventor’s name – A supporting document that reflects the name change, along with an official fee of NT$300.
- Change of the inventor:
- To add an inventor – Documents of proof and a consent form from each inventor named in the application and the newly added inventor, along with an official fee of NT$300.
- To delete an inventor – A statement from the deleted inventor declaring that he/she is not an actual inventor, along with an official fee of NT$300.
- To correct an inventor's name – If an individual has been erroneously named as an inventor in the application due to a clerical error, the applicant should submit a written request stating the reason and relevant documents of proof, along with an official fee of NT$300.
*If the applicant cannot obtain the inventor's consent or statement as mentioned above due to the inventor's health condition, death, or inability to contact the inventor, the applicant may file an affidavit instead.
- Change of title of invention/utility model/design – Submit the first page of the specification.
