[Taiwan] Accelerated Examination Program for Reexamination - One-year trial period of the Program starts on September 1, 2024

Starting from September 1, 2024, TIPO accepts the request for the Accelerated Examination Program for Reexamination (AEPRe). This program aims to provide greater flexibility while safeguarding the rights and interests of applicants.

The filing requirements for AEPRe are as follows:
  1. Qualified Case: Refers to an invention patent undergoing reexamination, where the decision of the preliminary examination only rejected part of the claims.
  2. Filing Time: The request for AEPRe must be submitted after the notice of Starting the Reexamination has been served and before the Office Action of the Reexamination is rendered.
  3. Acceptable Amendment: In accordance with Article 49 of the Patent Act, amendments must comply with the following:
    - Delete the claims that have been rejected due to grounds of non-patentability.
    Convert the dependent claims, which were not rejected based on non-patentability, into independent claims.
    The above amendments may include adjustments to the dependency of the Claims and adding new dependent claims.
TIPO guarantees that the applicant will receive either an office action or an approval decision within six months of requesting AEPRe, which helps expedite the patent acquisition process. The trial period of this program launches for one year, starting on September 1, 2024.
