[Taiwan] NEW PPH between Taiwan and Israel Effective January 02, 2026

The Israel Patent Office (ILPO) and the Taiwan Intellectual Property Office (TIPO) signed a Memorandum of Understanding on November 17, 2025, to collaborate under the Patent Prosecution Highway (PPH). The Taiwan-Israel PPH program will take effect on January 02, 2026.  

Under this bilateral framework, applicants who have received a favorable examination result from either TIPO or ILPO may request accelerated examination with the other office. To file a PPH request with TIPO under the TIPO–ILPO program, the following conditions and documentation are required: 

I. Application Requirements:
  • Same Earliest Filing Date:
    The TW application and its corresponding IL application must share the same earliest filing date (whether a priority date or a filing date).
  • Allowable Claims in the IL Application: 
    At least one or more claims in the IL application must have been determined to be allowable/patentable by the ILPO.
  • Sufficient Claim Correspondence: 
    All claims in the TW application (both at the time of PPH filing and after any amendments) must sufficiently correspond to the allowable claims in the IL application.
  • No First Office Action Received Yet:  
    The TW application must have received a notice indicating substantive examination will begin, but has not yet received a first Office Action.

     
II. Required Documents:
  • Office Actions of the IL Application and Their Translations: 
    The translated copy could be either in Chinese or English. The applicant does not need to submit copies of ILPO office actions if these documents are available via the Israel Patents Search system (https://israelpatents.justice.gov.il/search/en/home).
  • Allowable Claims and Their Translations: 
    All prior art references cited by ILPO during examination served as the basis for their decisions. A translation of the references is not required.
  • Cited References: 
    All prior art references cited by ILPO during examination served as the basis for their decisions. A translation of the references is not required.
  • Claim Correspondence Table: 
    A table mapping the correspondence between the claims in the TW application and those deemed allowable in the IL application.
